ARTICLE 1. FIRE LIMITS

The following shall be and are hereby declared to be the fire limits:

       Commencing at the intersection of Merchant Street and Third Avenue running thence west on Third Avenue to Illinois Street, thence south on Illinois Street to Sixth Avenue, thence east on Sixth Avenue to Merchant Street, thence north on Merchant Street, thence north on Merchant Street to point of beginning, so as to include Blocks, 24, 25, 32, 33, 38 and 39.

Every building hereafter erected or enlarged within the fire limits shall be enclosed on all sides with wall constructed wholly of stone, brick, tile, terra-cotta, concrete, or cement block provided that the mayor and council shall have authority to grant a building permit authorizing any other character of construction of buildings or improvements in the fire limits where in the judgment of the mayor and council such other types of construction, building, or improvement will not create an additional fire hazard.

Small frame outhouses, used as private garages, not exceeding 150 square feet in area and eight feet in height and temporary one-story frame buildings for use of builders may be built within the fire limits, provided, however, that such buildings shall not be located within 20 feet of any other building.

No frame building shall be moved from without to within the fire limits.  For the purpose of this article a building shall be classed as frame when the exterior walls or portions thereof are wood also a building with wooden framework veneered with brick stone, terra cota, tile, or concrete, or covered with plaster, stucco or sheet metal shall be classed as a frame building, such determination to be made by the city council.

All buildings hereafter erected within the fire limits shall have the roof, top and sides of all roof structures including dormer windows and mansard roofs, covered with incombustible material. No existing wooden shingle roof within the fire limits shall be renewed or repaired with other than incombustible of covering.

No person or corporation shall erect or cause to be erected within the fire limits of this city any structure of any kind or enlarge or add to the outside dimensions thereof nor relocated any building or structure, already erected within the fire limits, or which may hereafter be erected, within the fire limits, or which may hereafter be erected, without a building permit being first obtained therefor from the city clerk, approved by the mayor and council.  The application for such a permit shall be made and the permit obtained before the work is commenced upon the foundation for any such building begins, and such application shall state the exact site to be occupied, the material, dimensions, and estimated cost of the proposed building, structure, or addition, the purpose for which the same is intended to be occupied, the number of flues to be constructed within the same, and the probable time in which the work will be completed.
