CHAPTER XII. PUBLIC PROPERTYCHAPTER XII. PUBLIC PROPERTY\ARTICLE 2. MUNICIPAL AIRPORT

The Oswego municipal airport board, hereinafter known as the board, is hereby created for the purpose of advising the city council on matters relating to the development, maintenance, and operation of the airport, and to promote aviation and use of the airport for special events.  The board shall have no legislative or administrative authority.

The Airport Board shall consist of seven members appointed by the mayor and confirmed by the council. Four members must be residents of the city, and the remaining members must reside within Labette County or Cherokee County.

Two of the members shall have terms expiring April 30, 2013; two of the members shall have terms expiring April 30, 2014; and the remaining three members shall have initial terms expiring April 30, 2015. Thereafter each member shall serve a term of two years.

The board shall organize itself and elect a chairperson or presiding officer and a secretary and such other officers as may be deemed necessary, and adopt bylaws or establish rules and order necessary to carry out its purpose.

Members of the board shall serve without compensation.

Duties of the board include the following:

(a)   Recommend rules and regulations for the use and operation of the airport.

(b)   Prepare an annual maintenance and improvement plan prior to June 1 of each year.

(c)   Plan and implement special events utilizing the airport, such as fly-ins, aircraft auctions, airshows, etc.

(d)   Encourage use of the airport by individuals, clubs, and commercial enterprises.

It shall be permissible to fly model aircraft at the Oswego Columbus Area Airport by meeting the following regulations:

(a)   All takeoffs and landings shall take place on airport property; however, they shall not be conducted on the actual runway.

(b)   All model aircraft shall yield to all incoming and outgoing aircraft at all times.

(c)   The flying of model aircraft shall take place during daylight hours.

(d)   A radio to monitor aircraft operations will be required by any person(s) flying model aircraft at the Oswego Columbus Area Airport.

(e)   All model aircraft flyers shall obtain liability insurance and provide a copy to the Oswego City Office prior to use at the airport.

(f)   Any group consisting of six or more persons must provide 24 hour notice to the Oswego City Office prior to flying model aircraft at the Oswego Columbus Area Airport.

Any person violating any provision of this article shall, upon conviction thereof, be punished by a fine of not more than $500, or by imprisonment for not more than 30 days, or by both such fine and imprisonment.

The Oswego -city council may consider permitting special events for model aircraft flying. A minimum of 60 days notice must be given by the interested person(s) to the city council to allow an appropriate review time.
