CHAPTER XI. PUBLIC OFFENSESCHAPTER XI. PUBLIC OFFENSES\ARTICLE 1. UNIFORM OFFENSE CODE

There is hereby incorporated by reference for the purpose of regulating public offenses within the corporate limits of the City of Oswego, Kansas, that certain code known as the "Uniform Public Offense Code," Edition of 2024, prepared and published in book form by the League of Kansas municipalities, Topeka, Kansas, save and except such articles, sections, parts or portions as are hereafter omitted, deleted, modified or changed. One official copy of said Uniform Public Offense Code shall be marked or stamped "Official Copy as Adopted by Ordinance No. 1505," with all sections or portions thereof intended to be omitted or changed clearly marked to show any such omission or change and to which shall be attached a copy of said ordinance and filed with the city clerk to be open to inspection and available to the public at all reasonable hours.

(a)   Subsection 6.16 of Article 6 of the Uniform Public Offense Code relating to Giving a Worthless Check is hereby omitted and deleted.

(b)   Subsection 10.6 of Article 10 of the Uniform Public Offense Code relating to Air Gun, Air Rifle, Bow and Arrow, Slingshot, Paintball Gun or BB Gun are hereby omitted and deleted. The following will apply toward Air Gun, Air Rifle, Bow and Arrow, Paintball Gun or BB Gun:

All weapons must be used in a safe manner. Persons under eighteen years shall not shoot any type of weapon except under the direct supervision of a responsible adult.

(1)   Shooters must use a proper backstop, large and strong enough to stop any type of projectile used.

(2)   Shooters must not shoot in the direction of other property owners unless a proper backstop is in place.

(3)   Shooters may not shoot across alley or roadways.

(4)   Shooters shall not shoot while on another person's property without that person's permission.
